— TRE-RJ bars transfers of electoral and party funds to Silveira August 24, 2022 Candidate for the Senate for Rio de Janeiro, federal deputy Daniel Silveira (PTB) had access to the Electoral Fund and the Party Fund suspended by the Regional Electoral Court of Rio (TRE-RJ). Unanimously, the electoral judges accepted the request of the Public Electoral Ministry (MPE), which should be the first step towards rejecting the deputy's candidacy. Silveira was sentenced by the Federal Supreme Court (STF) to eight years in prison in a 2021 trial.

The injunction was granted by the rapporteur of the case, Minister Luiz Paulo da Silva Araújo Filho. In addition to the restriction on funds until the definition of his candidacy, Daniel will have to return the public resources already committed in a bank account to his campaign. The PTB will still have to pay a 10% fine on the amounts transferred to the candidacy after the injunction is published, the same percentage that will affect the amount committed by Daniel Silveira to fund campaign material.

The definition of the candidacy of Daniel Silveira, sentenced to eight years in prison by the Federal Supreme Court and pardoned by Jair Bolsonaro (PL), has not yet been made official by the Electoral Justice.

In the decision, the judge refers to the decision of the Superior Electoral Court (TSE) last week, which suspended the access of the Electoral Fund and the Party Fund to Roberto Jefferson (PTB), candidate for the Planalto Palace, who was also sentenced under of inquiries that investigate the organization of undemocratic acts and attacks on institutions. The merit must still be evaluated by the collegiate of TRE-RJ.

The magistrate, however, maintained Silveira's right to free electoral time, within the limits of the TSE's decision, until the contradictory is presented. He also did not assess the merits of a possible revocation of candidacy. His eligibility has been questioned due to his conviction in the STF. That is, he can be barred by the Clean Record Law.
