DR Hobart legal update

UPDATE - Good morning guys. I just want to thank you for all your support this week. It means so much to me and my family.

Unfortunately I lost my urgent Court application on Tuesday to keep the patient files which were seized by Victorian Dept of Health without a warrant confidential.

I was basically setup by the Department who gave a massive affidavit to the judge 50 minutes before the court case. That affidavit included an anonymous complaint against me to the department. I hadn’t seen that before and I didn’t have the time to respond to it before the case started. Even if I delayed the case by 2 days, the problem was the Department turned up with an army of lawyers and it would have cost me a fortune if had if delayed and then lost the application. So I had to run my application on Tuesday.

That’s how the Department beat me on Tuesday because the judge was persuaded by that evidence. So he refused  to grant me the injunction protecting the stolen patient files and preventing the Dept from sharing them with other government agencies like the Victorian Police.

Then on Thursday my registration as a doctor was suspended by the Medical Board of Australia. They were determined to get rid of me as a doctor and ignored my own arguments.

I strongly disagree with both decisions and intend to fight it. It will be a long, difficult and expensive battle.

Together we must fight and defeat the Pandemic Bill and the proposed bill to centralise all Victorian’s medical records in one computer database.

That bill is intended to destroy the confidentiality between doctors and their patients, as well as do away with privacy protections over patient records. It’s completely outrageous and we live in very strange times.
