KNOW YOUR RIGHTS - QR CODES!

There seems to be a lot of misinformation and confusion going around regarding QR codes.

Unless you can show that the information stored exceeds what is reasonably necessary or the information is not being stored in a safe location, then a business can mandate QR codes as a condition of entry.

For example, anything more than a name and phone number would exceed what is reasonably necessary.

PEOPLE USING THE PRIVACY ACT 1988 – SECT 94H:
This is only relevant to the COVIDSafe app, not QR codes!

Requiring the use of COVIDSafe
(1) A person commits an offence if the person requires another person to:
(a) download COVIDSafe to a communication device; or
(b) have COVIDSafe in operation on a communication device; or
(c) consent to uploading COVID app data from a communication device to the National COVIDSafe Data Store.
Penalty: Imprisonment for 5 years or 300 penalty units, or both.

SO WHAT ARE YOUR RIGHTS??
You can refuse to scan QR codes, if for example you don't have a phone or your phone isn't compatible with QR codes. In this scenario, you can either manually write your details down, or the employee can sign them into their device. Either way, you're in control of the details you provide and as stated above, only what is reasonably necessary.
