— "The president of the Superior Electoral Court (TSE) Alexandre de Moraes appointed, this Tuesday (23), the ministers who should act as election advertising judges in the period of campaign. Moraes guaranteed the permanence of the minister Cármen Lúcia in the position instead of appointing the substitute minister Kassio Nunes Marques. The appointment still needs to be endorsed in plenary.

Nunes Marques was appointed to the Federal Supreme Court (STF) by President Jair Bolsonaro (PL) and assumed the post of substitute minister in the TSE. Carmen retaining the role of electoral judge prevents Nunes Marques from taking care of electoral propaganda this year.

Traditionally, this role is the responsibility of substitute judges, as is the case with Nunes Marques. A 2019 resolution provides that the function is the responsibility of those who are not part of the effective plenary.

Keeping the minister in office, however, reduces Bolsonaro's power of influence in the area of ​​the TSE in charge of monitoring and punishing excesses in advertising during the electoral dispute. Court sources believe that Carmen Lúcia must be firm in the fight against false news linked to the presidential candidates.
The appointment of the minister to this role is unconventional. The supervision of electoral propaganda is traditionally carried out by substitute ministers coming from the legal profession and from the Superior Court of Justice (STJ). But this vacancy is still waiting for Bolsonaro’s appointment since May because of the resignation of former minister Carlos Mário Velloso Filho for health reasons. The person appointed by the president could assume the role of judge of electoral propaganda.
Bolsonaro was unhappy with the triple list formulated by the Federal Supreme Court (STF) for considering that all the lawyers appointed represent, to some extent, barriers to the government. In the race are lawyers André Ramos Tavares, Fabrício Juliano Mendes Medeiros and Vera Lúcia Santana Araújo. The president, however, did not indicate when he should make the appointment. Also in March, Cármen Lúcia had been nominated to act as a judge of electoral advertising by the then president of the TSE, Edson Fachin, before assuming the vacancy of effective minister. At that time, the choice of magistrate was seen as temporary, since in the following months Bolsonaro was supposed to appoint a new minister.
In addition to Carmen, substitute ministers Raul Araújo, Paulo de Tarso Sanseverino and Maria Cláudia Bucchianeri were nominated for the post of judge of electoral advertising."
