What about mask mandates and exemptions?

In accordance with section 8 of the Movement and Gathering Order (No. 1) and reconfirmed on the DHHS website, there are no changes to rules regarding masks and mask exemptions. However, with the new legislation there is now a risk of being fined up to $10,898.40 (for an individual) for failing to comply with a pandemic order.
 
The DHHS website confirms that; “you do not need a medical certificate stating that you have a lawful reason for not wearing a face mask. If you have a lawful reason for not wearing a face mask, you do not need to apply for an exemption or permit.” It goes on to say, “if you are stopped by police in a setting where face masks are mandatory, they will ask you to confirm the lawful reason you are not wearing a face mask.”
 
However, be mindful that legislation does provide powers to the police who (as an authorised officer under the Act), have the right to act in response to a perceived threat to public health or a suspected breach of a Pandemic Order. Therefore, they hold the right to request the reason for not wearing a face mask and may still ask to provide evidence of that reason.
