[Sent on 3 Mar 2022] Grant of Ex-gratia Extension of Time (EOT) to Contractors due to COVID-related delays for Public Sector Construction Contracts from Jul 2021 to Feb 2022
While the industry’s construction output has recovered close to pre-COVID levels, we recognise that the COVID-19 pandemic continued to impact site productivity due to border restrictions in the second half of 2021.
To mitigate the impact on eligible public sector construction contracts that have on-going works from 1 Jul 2021 to 28 Feb 2022: The Government will grant an ex-gratia EOT of 33 days. No claim or application is required from contractors.
Parties in private sector contracts are encouraged to make reference to the ex-gratia EOT provided and provide similar reliefs to contractors, where appropriate.
This will be the final broad-based grant of ex-gratia EOT for public sector construction contracts arising from COVID-related delay. For EOT after 28 Feb 2022, contractors can request for EOT arising from COVID-related delay with substantiation for their respective government agency clients to assess.
