The most common reason for the delay of land-related cases in Pakistan’s judicial system is the unnecessary adjournment of cases, re-hearings, and slow progress in evidence built-up. It is most often the case that decisions are suspended over decades, and generations of families are involved in litigation processes (Dawn, 2018). Considering the present situation, the establishment of a real estate regulatory authority will also ensure speedy dispute resolution through the establishment of an adjudication mechanism. According to the Islamabad real estate regulation and development bill 2018, an appellate tribunal known as Federal Real Estate Appellate Tribunal will be established within three months of enforcement of the act. This means that all cases regarding the real estate sector, pending in any court of law, will be transferable to the appellate tribunal. Some mechanisms will ensure the speedy processing of cases as the accused will have to deposit 30 per cent of the penalty charges upon hearing of the case in cases of developer fraud. Each case will also be given preference within 60 days. Up to 80 per cent of Pakistan’s civil caseload is to do with land acquisition and titling disputes. The formation of RERA will also streamline the process of land titling, and therefore, this will also help in lowering cases related to land titles. Lastly, land administration officers do not explain or publish procedures related to documentation, land records, and the validity of officials. RERA aims to increase awareness among the masses in this regard and can significantly reduce the chance of disputes arising. (Government of Pakistan, 2020)

Conclusion
Pakistan is facing a crisis in terms of litigation of land-related cases. The real estate regulatory authority will greatly impact the resolution of land disputes by the establishment of an appellate tribunal that will only hear land cases. Mechanisms will be placed to ensure that cases are swiftly resolved and appeals made to current cases are taken on a priority basis. As there are many reasons for land disputes ranging from ownership, tenancy, inheritance, and developer fraud, the formation of a real estate regulatory authority will positively impact the situation.

How RERA will Impact Dispute Resolution in Real Estate

Preamble
As real estate is a valuable commodity in any society, disputes over its possession, ownership, control, and trade are common. Pakistan is marred by an ineffective judicial system that is over-burdened by land cases. It is reported that over a million cases are pending in the country related to real estate. As a solution to this problem, establishing an appellate tribunal under a real estate regulatory authority can greatly impact dispute resolution throughout Pakistan. Introduction
Throughout the world, real estate is considered among the most valuable assets. That is true for any country as land rarely depreciates and is also linked to many socio-economic growth indicators. Disputes in land and property are increasingly being witnessed across many areas of Pakistan. They are mainly related to the title of the property, property inheritance or will, damaged property, ownership dispute, and tenancy issues. The justice system of Pakistan remains inefficient as matters related to land are connected with the revenue department. Dispute Resolution in the Real Estate Sector
Dispute resolution is the process of solving disputes between two or more parties whenever conflict arises. The techniques used in the process include citizens, governments, business entities, and corporations. Although it is usually done in courts, other methods like arbitrations, mediations, and conciliations are common in the real estate sector. Pakistan lacks a digital record of land titles, and there are high chances of fraudulent activity. This also makes verification of property titles a difficult task for the common public as not everyone can access the revenue department. Recently, a large number of new developers have come up with new projects that are not regulated under any authority. This makes buyers vulnerable to scams as the developer is not bound to fulfil his duty to the buyer. Moreover, disputes regarding the inherited or willed property are also common as, most often, the credibility of the will is challenged. Most people also don’t check claims to a property and the actual ownership of the seller at the time of buying. Lastly, disputes are common when it comes to rented or leased property. It is mainly because prior rules to the agreement are either not understood properly or are miscommunicated to entice potential customers. (Ayush, 2020)

کی پہلی سہ ماہی میں 52 فیصدسے زائد صارفین کا ماننا تھا کہ اگلے6 ماہ میں بے روزگاری کی شرح میں مزید اضافہ ہوگا۔

سال 2021 کی پہلی سہ ماہی میں صارفین کے اعتمادکا انڈیکس سہ ماہی بنیادوں پر 10.8 فیصد کمی کے ساتھ 80.8 پوائنٹس رہا۔ حکومت کی کورونا وائرس کی تیسری لہر کا مقابلہ کرنے کیلیے کاروباری سرگرمیوں پر عائد پابندی کے باعث اعتماد کی فضا میں کمی واقع ہوئی۔

موجودہ صورتِ حال کے باعث مستقبل کے بارے میں صارفین کی توقعات میں بھی 12.0 فیصد کمی دیکھنے میں آئی جس سے اس سہ ماہی میں 8.3 فیصد کمی واقع ہوئی ہے۔ یہ بات ڈن اینڈ بریڈ اسٹریٹ پاکستان اور گیلپ پاکستان نے مقامی صارفین کے اعتماد کے اشاریوں پر مبنی جاری کردہ مشترکہ سروے رپورٹ میں کہی ہے۔
ڈن اینڈ بریڈ اسٹریٹ کے کنٹری منیجر نعمان لاکھانی نے کہا ہے کہ کنزیومیر کانفیڈنس انڈیکس کے پانچویں شمارے کا اجرا سال2021 کے آغاز میں کردیا گیا ہے جس میں صارفین کے اعتماد میں سہ ماہی بنیادوں پر 10فیصد سے زائد کمی سے صارفین کے بڑھتے ہوئے خدشات کی عکاسی ہوتی ہے جبکہ موجودہ صورتِ حال کے مقابلے میں مستقبل کی توقعات میں کمی سے ظاہر ہوتا ہے کہ صارفین مستقبل کے بارے میں بھی زیادہ فکر مند ہیں۔

گیلپ پاکستان کے ایگزیکٹیو ڈائریکٹر بلال اعجاز گیلانی نے سروے رپورٹ پر کہا کہ2021 کی پہلی سہ ماہی میں صارفین نہ صرف موجودہ صورتِ حال کے بارے میں پریشان ہیں بلکہ مستقبل کے بارے میں بھی گھبراہٹ کا شکار ہیں۔کورونا کی تیسری لہر کے باعث حکومت کی جانب سے بڑے شہروں میں لاک ڈاؤن، کاروباری اوقات میں کمی، اسکولوں کی بندش کی وجہ سے بے روزگاری کے خدشات وسط 2020کی سطح پر بڑھ رہے ہیں۔

پاکستانی صارفین جن کے تاثرات ہم نے سی سی آئی رپورٹس میں جاننے کی کوشش کی ہے مستقبل کے بارے میں محتاط طور پر پرامید ہیں جس کی بنیادی وجہ گھریلو معاشی صورتِ حال میں ابتری اور بڑھتی ہوئی بے روزگاری کے خدشات ہیں۔ توقع ہے کہ حقیقی چیلنج معیشت کو کورونا سے پہلے کے دور پر بحال کرنا نہیں بلکہ اصل چیلنج یہ ہے کہ معیشت کو تیزی رفتار ترقی کی طرف گامزن کیا جائے۔7فیصد سے 8فیصد کی سطح پر افراطِ زر پر عام آدمی قوتِ خرید رکھتا ہے۔

گیلپ پاکستان امید کرتاہے کہ نئے وزیرِ خزانہ کی جانب سے صارفین کیلیے قلیل مدّتی ریلیف لانے کیلیے مثبت پالیسیاں متعارف کرائی جائیں گی۔ موجودہ سہ ماہی کے دوران سی سی آئی کے تمام پیرامیٹرزمیں مجموعی طور پر کمی دیکھنے میں آئی ہے۔

اسمارٹ لاک ڈاؤن کو دوبارہ شروع کرنے کی وجہ سے ملک کی معاشی حالات کے بارے میں صارفین کے جذبات میں سب سے زیادہ مایوسی دیکھنے میں آئی جس میں 16.0 فیصد کمی واقع ہوئی۔پہلی سہ ماہی کی دوران گھریلو مالیاتی صورتِ حال واحد پیرامیٹر تھا جو 2020 کی پہلی سہ ماہی کے بعد پہلی بار کمی کے باوجود 100پوائنٹس سے اوپر رہنے میں کامیاب رہا۔

رپورٹ کے مطابق بے روزگاری میں اضافہ صارفین کے اعتماد میں کمی کررہا ہے اور رپورٹ میں یہ سب سے زیادہ مایوس کن پیرا میٹر رہا جس میں سہ ماہی بنیادوں پر 15.7 فیصد کمی واقع ہوئی۔

رپورٹ کے مطابق 2020 کی تیسری اور چوتھی سہ ماہی کے بالترتیب 39 اور 42 فیصد صارفین کے مقابلے میں 2021 کی پہلی سہ ماہی میں 52 فیصدسے زائد صارفین کا ماننا تھا کہ اگلے6 ماہ میں بے روزگاری کی شرح میں مزید اضافہ ہوگا۔ پہلی سہ ماہی کے دوران 92فیصد صارفین کا خیال تھا کہ روز مرہ کے لوازمات گذشتہ 6 ماہ کے دوران مہنگے سے مہنگے ہوتے چلے گئے۔

To
avoid practice of double payment of sales tax on vehicles auction, the Federal Board of Revenue (FBR) has legally clarified that no sales tax is chargeable on auction of serviceable old and used vehicles provided sales tax has already been paid at the time of local or import stage.

Official sources told Business Recorder that the FBR has issued this new clarification following issuance of conflicting letters and self-contradictory clarifications in the past to the field formations.

As a result of conflicting clarifications, the buyers or purchasers (bidders) of the old and used vehicles were forced to pay 17 percent sales tax at the time of auctions done by the government departments/autonomous bodies.

The question was raised whether sales tax is chargeable on a serviceable old and used vehicles at the time of auction where sales tax has already been paid on it at the time of first purchase within Pakistan.

It is learnt that the FBR Sales Tax Policy Wing has clarified the issue to the FBR Sales Tax Operations Wing/FTO, but the same has not been communicated to the FBR's field formations.

The FBR's said clarification is not available with the Collectors of Customs or Chief Commissioners in the field formations for compliance.

According to the FBR, the issue of chargeability of sales tax on auction of vehicles has been examined, keeping in view the clarifications issued by the Board from time to time.

Following are the views and comments on the Board: It is intimated that Board from time to time issued various clarifications vide letters dated August 2, 2006; November 21, 2013; January 7, 2020 and November 13, 2020, wherein, it has been conveyed that sales tax is not payable on old and used vehicles auctioned/sold by the government departments/ autonomous bodies, where tax was paid at the purchase/import stage.

However, the said exemption is not applicable to the vehicles which were brought into the country or purchased by the auctioning department without payment of due sales tax, which is still in the field and binding on government departments/autonomous bodies, the FBR said.

However, the clarification vide letter dated November 20, 2020 has been issued in the broader context which implies that on auction of goods including vehicles sales tax is chargeable @17% in terms of section 2(33)( b) of the Sales Tax Act, 1990.

In this regard, Board is pleased to clarify that on auction of serviceable old and used vehicles if sales tax has been paid at the time of local or import stage, no sales tax is chargeable on auction of stated vehicles.

Whereas, on auction of unserviceable/ condemned old and used vehicles, the same shall attract charge of 17 percent sales tax from the bidders, irrespective of the fact that sales tax has already been paid on such imported or locally purchased vehicles and tax so charged be deposited into the federal government treasury accordingly, the FBR added.
