I have evidence that proves Penzone wasn’t just brought in as a pretty face, but actually the “COO”, Chief Operating Officer of Not My Kid.

That means he was intimately involved in the overall finance for the “non-profit” so soon after the scandal.

What deals did Penzone oversee during his time as COO?

On October 18, 2010, Paul Penzone, a former Phoenix P.D. officer was named as the new Director of Prevention Program at notMYkid.
 
Paul comes to notMYkid as a retired Sergeant of the Phoenix Police Department. Paul spent 21 years with the Phoenix P.D. and a great portion of his time was assigned to the Narcotics Bureau in an undercover capacity which included a three year assignment on a federal task force with the DEA. 

During Paul's last assignment he moved on to be program coordinator for the Silent Witness Program and in his time there, the program saw a 140% increase in arrests.
 
Following his retirement with the Phoenix P.D. Paul served as Vice President of Prevention Programs and Special Projects with Childhelp, a non-profit organization dedicated to helping victims of child abuse and neglect.
 
Paul is a two time recipient of both "Supervisor of the Year" and "Distinguished Service" awards from Phoenix P.D. and is recognized as "Task Force Agent of the Year" in the United States for dismantling a Methamphetamine distribution ring controlled by Aryan Brotherhood in 1997/1998.

2022-06-15 22:38:51 We approached several companies and asked them to sponsor a prevention program and give away product to help with prevention, to no avail. Believing strongly that we had discovered a way to keep kids off drugs we took even bolder actions. In 2004, when no one else would step up, we put a group together to find and purchase an insolvent home diagnostic company that had developed a rudimentary at-home drug test device. We poured money and time into this company, developed new and dramatically improved products. We used this company to make the programs we dreamed of available to kids and parents in Arizona and eventually across the nation. First Check donated about $150,000 and approximately 10,000 drug test kits each year to the program. In 2007, Inverness Medical approached me to purchase the entire line of products we had created. We sold First Check with a contract that the company would continue to provide the same program we had created to support notMYkid. That contract continues today with notMYkid. We don't deny that notMYkid extolled the virtues of home drug testing as it did from the very beginning and still does today. In fact, notMYkid's main drug prevention program, Project 7th Grade, aggressively promotes home drug testing... because the organization believes it works! Because of this program and its impact President Bush appointed me to the White House Drug Free Commission during his 2nd term. And here's the irony--while we owned First Check, we made test kits available to notMYkid and Project 7th Grade FOR FREE. And, they are still supplied today FOR FREE--even though we haven't owned the drug test company for 3 years--First Check continues their support for this program of notMYkid. We believe that this is exactly the kind of bold actions that more individuals and companies should take to solve such serious issues facing our children. The bottom line is: my wife Debbie and I would do this all again. We are proud of notMYkid and proud of the home drug test product line we helped to create and make available, through our sale of this business, across the country. We are NOT going to be dragged down by this "politics as usual." We plan to fight for what is right, and for you. We will continue to answer any questions anyone has on this topic, but in the end you need to answer one question: Were the Moak's trying to prevent other families from the problems they faced, or have they spent the last 10 years (only 3 of which they owned a drug test company) looking out for themselves? You decide. Deb and I especially want to thank everyone who has reached out to support us over this issue. Moak's media flak, Jerry Cobb, promised New Times last week that a "big shoe" would be dropped on Quayle simultaneous with Moak's response to his questions. We're yet to see any shoes drop from the Moak campaign, but Quayle dropped one of his own.

Quayle wasn't too impressed with Moak's response, saying that while it responds to his questions, "it fails to answer them." As a result, Quayle is seeking new legislation that would make it a felony to use a non-profit organization in any way to promote or enrich a for-profit entity controlled or owned by the same person.

"What was done with these two organizations was wrong and the non-disclosure of the connection was illegal under existing law," Quayle says. "But we can make the laws even stronger to prevent this kind of self-dealing and self-enrichment in the name and under the cloak of charity.  People need to be protected from this type of unethical behavior."

Steve Moak Responds to Criticism of Charity's Connection to His Business; In Response, Ben Quayle Calls for New Legislation

Congressional candidate Steve Moak has finally responded to questions posed to him last week by one of his opponents in the crowded District 3 Congressional primary. In short, Moak never disclosed a conflict of interest to the IRS when a not-for-profit anti-drug charity he founded was pushing the drug tests produced by his for-profit business. Moak sold the business for $25 million and claims there was never anything illegal or unethical about his ties to each business. The criticism is that Moak used his not-for-profit charity as a marketing arm of his for-profit business, resulting in a huge profit when he sold the company. Questions about Moak's charity were first raised by New Times a few weeks ago, so we figured we'd give Moak equal time to defend the criticism. See Moak's letter, in its entirety, after the jump.

The “Letter”
Dear Friends and Supporters,

Some of you may be wondering about Ben Quayle's recent attempt to disparage the charity we founded, notMYkid. This is clearly a way for the Quayle campaign to divert attention away from Ben's real life issues as Steve has taken the lead in the polls. I know many of you have been asked about the questions raised in a negative attack mail piece sent out by the Quayle campaign. Here are the factual responses to these questions.
1. Why didn't you disclose the connection between notMYkid and First Check on IRS statements like you are legally required to? notMYkid has always fully disclosed its relationships with First Check and other organizations. A clerical error appeared on line 80 of notMYkid's original 2007 tax return. An amendment has since been filed by their accounting firm to correct this error.

2. Why didn't you tell donors at the time of the conflict? Steve Moak's position with First Check was widely known and never concealed from donors, nor was it a conflict.

3. Why did you use 80% of donors' money in 2005 to promote First Check? No money, including contributions from donors, has been used by notMYkid to promote First Check or to purchase products from the company. The majority of contributions received in 2005 were spent on drug prevention programs, which is the mission of notMYkid.

4. Why was the reference to you being the Chairman of First Check suddenly removed from the notMYkid website? The reference to Steve Moak as Chairman of First Check was removed from notMYkid's website because it was out of date. Steve's involvement with the company ended in 2007.
Keep in mind as I share some facts with you, that notMYkid has been providing prevention education programs in Arizona for over 10 years with only positive community interaction. Only in politics can good deeds be punished. Also keep in mind that everything Deb and I have done in regard to notMYkid and First Check we would do all over again tomorrow as this has helped save thousands of children and families from the scourge of drug abuse. In 1999 after struggling with our son's drug abuse, we founded notMYkid, a 501(c)3, along with addiction specialist Dr. Mark Rohde and a board of directors. One of the primary ways that we discovered our son's drug use was through the use of a home drug test kit. We felt strongly that if we had been testing our son prior to his first use he would have had an acceptable way to say no to peer pressure. Beginning in 2000, Deb and I regularly purchased home drug tests by the case and gave them away to parents for free as part of our presentations to encourage them to not let these doors get opened in their own homes. Parents responded with gratitude for the free tests that we gave them to help in their homes. Deb and I gave away hundreds of drug test kits in those early years to anyone who would listen.

2022-06-15 18:34:57 Cobb admitted that the First Check kits are the only drug-test kits Not My Kid has ever promoted by name on their website, but he said the Not My Kid website has never sold the kit, nor does it have the ability to do so, refuting claims made by the Quayle campaign.

It was practical to have First Check donate drug-test kits to Not My Kid, but Cobb said that in no way were the donations responsible for the success of First Check.

Cobb said the turnaround of First Check, which also produces a home-colon test and a home-cholesterol test, is largely the result of getting the company’s tests into stores.

“Steve is a businessman. He’s an entrepreneur,” Cobb said.
Cobb said the donation of First Check’s drug tests to Not My Kid is no different from any other company that donates some of its products to a nonprofit organization.

“No one would say Apple built its business on the back of a charity that puts computers in schools,” Cobb said. “Does that help the market for Apple? Well, probably it does.”

But Cobb said there was nothing illegal or unethical about the donations.

As for the claims about false IRS reporting, the Quayle campaign alleged that Not My Kid failed to disclose Moak’s involvement with First Check on its 2005 and 2006 IRS reports.

In nonprofit tax reports that were filed those years by Not My Kid, the organization answered “no” to the question of whether the organization is related to any other organization through common membership.

But in 2007, Not My Kid reported “yes” to this question, which the Quayle campaign said indicates a skirting of the issue all along.

Cobb said this was an error made by the organization’s accountant. Not My Kid’s accountant, Cherie Wright, wrote a letter Aug. 9, stating that the answer was an error and needed to be fixed, but only after this was brought to their attention.

According to IRS documents, the threshold for answering this question “yes” is required only when 50 percent of an organization’s governing body, officers, directors, trustees or members are part of any other organization.

Wright explained in her letter that because only two members, Moak and his wife Debbie, or 14 percent of Not My Kid’s board, were part of First Check, the answer should always have been “no,” and that the 2007 answer was incorrect.
Cobb said the Moak campaign stands by Wright’s assessment.
“Our accountants and Not My Kid’s independent board have reviewed it,” Cobb said.

Cobb also said that the fact that no scrutiny has come from the IRS on these points further indicates no wrongdoing.

Moak was publicly busted red handed, moving millions leveraging his “non-profit”, to benefit himself personally, with self evident contradictions on tax forms.

Originally a call center business man from the 90’s, Moak’s desire to be a player in Arizona politics dwindled as a front facing force, after he was exposed.

Behind the scenes though, Moak and his wife have ingratiated themselves into the Ducey machine, feeding at the tax payer trough, grabbing one tax payer funded shady deal after another these last 8 years. This “non-profit” swindle was just a dress rehearsal.

Quayle claims Moak made millions off charity; Moak says not so

Businessman and philanthropist Steve Moak has been on the defense this week after political rival Ben Quayle claimed in a flyer that Moak used his nonprofit charity to make millions for his former company.

The two are running in the crowded Republican primary in Arizona’s 3rd Congressional District, and rhetoric between the well-funded campaigns has been fierce.

In addition to claims that Moak used his Not My Kid charity to enrich his former company, which he sold for $25 million in 2007, Quayle alleges Moak broke the law by failing to report to the IRS that he had an interest in both organizations.

“From the attorneys we talked to, this relationship needed to be disclosed. So, yes, this is illegal,” said Megan Rose, a Quayle campaign spokeswoman. “And if he profited to the tune of $25 million from this relationship, then this is unethical too.”

Moak’s campaign said the allegation is unwarranted and based on a lack of understanding about IRS reporting. Moak’s for-profit company was successful because of sound business practices and that Quayle is simply trying to smear Moak because he sees him as the latest frontrunner, said Jerry Cobb, a Moak campaign spokesman.

They finally woke up to the fact that we’re in first place,” Cobb said.

In 2000, Moak began Not My Kid to promote awareness of drug use in adolescents and to help parents prevent their kids from using drugs.

In 2004, Moak purchased First Check Diagnostics – a maker of drug-test kits and other medical test kits – while the company was going through Chapter 11 bankruptcy. In 2007, Moak sold the company for $25 million.

During the years that Moak owned First Check, his charity developed a separate program called the “7th Grade Program,” which included a presentation and a one-time free drug-test kit for any parents who wanted one.

The drug kits given out as part of the 7th Grade Program presentation were produced and donated by First Check. The Quayle campaign said this amounts to using the non-profit to push the drug kits into the hands of parents and creating a market demand for First Check’s product.
Moak’s campaign said this story doesn’t add up. Moak bought First Check because he saw a scarcity of affordable, easy-to-find home drug-test kits, which naturally fit into the Not My Kid curriculum, Cobb said, and because Moak felt he could turn the company around by instituting better business practices.

Paul Penzone, Former "Face" of Silent Witness, Announces Candidacy to Unseat America's Priciest Sheriff

Paul Penzone, a retired sergeant from the Phoenix Police Department/Nancy Grace suck-up, officially announced his candidacy in this year's race for Maricopa County sheriff.

Penzone, best known for being the public "face" of Silent Witness, announced his candidacy on his website this morning (see his first campaign video after the jump). He vows to make Maricopa County the "safest community in America"

"It is time for professional law enforcement leadership in Maricopa County," Penzone says in a press release. "There is a crisis of leadership in the Sheriff's Office. It is unacceptable when sex crimes against women and children go uninvestigated, and when criminals are allowed to run free on our streets. I'm going to reach out to every single person in our community and ask them to help me retire Joe Arpaio and move the Sheriff's Office in a new direction."

So far, there are two other horse's in the race for sheriff -- 79-year-old Maricopa County Sheriff Joe Arpaio, and Scottsdale Lieutenant Mike Stauffer, who is running as an independent (Stauffer, a life-long Republican, switched party affiliation last year to avoid facing Arpaio in a primary).

*It's unclear whether Penzone will run as a Republican -- his campaign spokesman, Doug Mings, didn't immediately respond to an email asking that question. If he does run with an "R" next to his name, he'll have to face Arpaio in a primary.*

If Penzone runs as a Democrat or independent, he'll likely split the anti-Arpaio vote with Stauffer, which would be beneficial to America's priciest sheriff -- and probably lead to four more years of the Arpaio regime.

Arpaio -- again, at 79 years old -- announced earlier this month that he plans to seek a sixth term as sheriff, despite a rather humiliating 2011 for the MCSO under his (gulp) leadership (a Mexican drug cartel infiltrating his office, a scathing Department of Justice report claiming he's guilty of the worst racial-profiling practices in U.S. history, and the fallout from the Munnell Memo, etc.).

*Aside from his time with the Phoenix Police Department, Penzone served as the Chief Operations Officer for notMYkid, a (supposedly) non-profit organization aimed at educating parents and children of the dangers of drug and alcohol abuse.*
