I am looking for a little insight for my lawyers. We had our PI hearing yesterday in Omaha and the judge is very interested to know what restrictions (e.g. no deployment, no PCS, no training), if any, someone with a medical or administrative exemption might have.

Essentially, if we can prove there are med or admin exemptions, for members that are going to remain in the service, that don’t have restrictions then we may convince the judge that the government has no sufficient compelling interest to deny religious accommodations.

I’m sorry to ask, but if you have anything our counsel needs evidence of this within the next few hours because he only has until 1700 today to present this evidence in 5 pages or less. Any help you can provide is very much appreciated.

2022-05-04 04:46:48 For those asking why this matters- it shows that the DoD acknowledges there is a difference in “vaccines.” Their whole gimmick is that they view them as interchangeable and because of this, have not been granting MS code exemptions, but now they are saying if we don’t want an EUA vaxx, we can request a BLA one. We all know BLA is not approved but it hurts the DOD’s claim that they are all the same. Open / Comment
