Extension of Support Measures for Businesses in the Construction, Marine Shipyard and Process Sectors
The Government is extending support measures for companies in the Construction, Marine Shipyard and Process (CMP) sectors in view of the continued manpower shortages and elevated business costs arising from COVID-19.
Extension of COTMA Part 10A for Construction Contracts
COTMA Part 10A will be extended for an additional 3-months, to 30 June 2022.
Part 10A – Relief for increase in foreign manpower salary cost
Contractors may seek a determination from an Assessor for the increase in foreign manpower salary costs of construction work permit holders (WPHs) due to COVID-19, for the period between 1 Oct 2020 and 30 June 2022.
An application for determination should be made before 31 August 2022, if the contracting parties are unable to reach an agreement on the adjustment of their contract sum.
We urge contract parties to agree on amicable outcomes for their contracts and to deepen partnerships, so as to ensure business sustainability and the longer-term resilience of the BE sector.
Extension of Foreign Worker Levy (FWL) rebate for CMP Work Permit Holders (WPHs)
The Government will extend the FWL rebate for CMP WPHs for another three months, at $250 per month for April and May 2022, and $200 for June 2022.
Removal of Period of Employment (POE) requirement for Man-Year Entitlement (MYE)-waiver
The Government will now make the removal of the minimum POE requirement permanent, in line with the dismantling of the MYE framework from 1 Jan 2024.
All incoming or renewal of NTS and PRC WPHs will no longer need to meet the minimum POE requirement to qualify for the MYE-waiver.
Prior Approval (PA) is not required to register for the Skills Evaluation Certificate (Knowledge), or SEC(K), trade test at Overseas Testing Centres. New workers who pass the SEC(K) will be eligible for construction work pass under MYE-waiver.

延长对建筑、海事和加工业的援助措施
鉴于建筑、海事和加工业仍因冠病疫情而面对人手短缺以及人力成本增加,政府将延长对这些业者的援助措施。
延长冠病19(临时援助措施)法令第10A部分对建筑合同的宽限期
冠病 19 (临时援助措施) 法令 (以下简称“COTMA”) 第 10A部 分的宽限截止日期将延长三个月至2022年6月30日。
COTMA第 10A部 分: 帮助业者应对外籍人力成本增加
承包商可以在2020年10月1日至2022年6月30日期间,申请由评估员裁定所需调整的合同金额,以应对因冠病疫情导致外籍工作准证持有者的工资成本增加。
如果建筑合同双方协商后无法达成相互同意的安排,承包商必须在2022年8月31日之前提出由评估员裁定的申请。

为建筑、海事和加工业的工作准证持有者延长外籍劳工税回扣
政府将延长建筑、海事和加工业的工作准证持有者的外籍劳工税回扣三个月,在2022年4月至5月期间每名工作准证持有者(WPH)的回扣额为每月250元,2022年6月为200元。
废除外劳配额制度中的最低就业年限限制
配合2024年1月1日废除外劳配额制度的决定,政府将永久废除最低就业年限的约束。
业者新引进或续聘的非传统客工来源国和中国客工时,可为工人申请豁免外劳配额工作准证, 工人将不必持有最低就业年限。
在海外考试中心报名参加技能鉴定或简称SEC(K)时,不再需要事先呈交批准函(Prior Approval)。通过SEC(K)技能鉴定的新入工人可豁免受外劳配额限制获得建筑工作准证。
