Streamlining of Covid-19 Requirements for The Construction Sector

With effect from 15 March 2022, BCA will be removing all sectoral COVID-19 rules for the Construction Sector. With this, all COVID-19 workplace requirements for the Construction Sector will be set out in the Workplace Safety and Health (COVID-19 Safe Workplace) Regulations 2021 (hereon, “WSH Regulations”).

The key changes from 15 March 2022 onwards are highlighted below:

Construction worksites and supply works premises will be subject to the same SMM requirements that apply to any other workplace regulated under the WSH Regulations, with no additional sectoral requirements imposed.

Main contractors and subcontractors performing work at construction worksites and supply works premises should take reasonably practicable steps to comply with the WSH Regulations.

Construction companies will no longer need to apply to BCA for approval of resumption and/or commencement of works and deployment of personnel to construction worksites and supply works premises (i.e. Restart Applications).
We strongly encourage all occupiers of premises and employers to continue to apply pre-existing SMMs as part of a good practice to contain COVID-19 transmission at worksites.

简化建筑业冠病19防疫规定

从2022年3月15日起，建设局将撤销所有专为建筑业制定的防疫规定。接下来，建筑业只需遵守2021年《工作场所安全与卫生（冠病19安全工作场所）条例》所列出的所有冠病19防疫规定。

下列改变将从2022年3月15日起生效：

建筑工地和建筑材料供应场地将跟其他工作场所一样，遵守同一套工作场所安全与卫生条例，不再需要遵守专为建筑业制定的额外规定。

建筑工地和建筑材料供应场地的主要承包商和分包商应采取合理又实际的步骤，以严格遵守工作场所安全与卫生条例。

建筑业者将不再需要向建设局申请开始或恢复工程项目/，以及部署人员到建筑工地和建筑材料供应场地的批准（Restart Application）。

不过我们大力鼓励所有场地用户和雇主继续采用现有的安全管理措施，作为防止冠病病毒在工作场所传播的良好作业方式。

我们希望您能继续给予配合，遵守工作场所安全与卫生条例，以及社区内所实行的防疫措施，以保障工作场所的安全。

AccessCode Changes from 17 March 2022

From 17 March 2022, the AccessCode status for the following groups of workers will be turned “red” and they will not be allowed to go to work:

Workers who test positive using ART or PCR test
Their AccessCode status will turn “green” after they complete the COVID-19 recovery protocol. Workers who are not living in dormitories will follow the community measures.

Workers staying in the dormitories who are still required to be on RRT but missed their ART based on the RRT schedule
They should take an ART and upload the results into FWMOMCare. Their AccessCode status will take up to 6 hours to turn from “red” to “green”, if they have a fully vaccinated status.

All unvaccinated or partially vaccinated workers, including workers who have recovered from COVID-19 beyond 180 days from their date of infection, but have not completed their vaccination requirements
They should complete their full vaccination regime and take their booster shot when scheduled in order to maintain their fully vaccinated status.

通行码从2022年3月17日起作出调整

从2022年3月17日起，以下组别客工的通行码（AccessCode）将显示“红色”，而不被允许到工地工作：

抗原快速检测（ART）或聚合酶链式反应（PCR）检测结果呈阳性的工人
当他们完成卫生部冠病医疗方案后，通行码状态才转为 “绿色通行证”。不住在客工宿舍的工人将需遵循社区当前采取的防疫隔离措施。

住在客工宿舍的工人若仍需要接受定期检测（RRT），但却忘记或错过按照定期检测指定的时间内进行抗原快速检测（ART）
他们应该即可进行抗原快速检测（ART），并将检测结果上传到FWMOMCare 应用。已完成疫苗接种的工人，他们的通行码状态大约需要6个小时才能从 "红色 "转为 "绿色通行证"。

所有还未接种疫苗或只接种一剂疫苗的工人，包括那些感染冠病后已康复超过180天，但还没有完成疫苗接种的工人
他们应尽早完成疫苗接种，并在受邀时前去接种追加剂，才能保有完全接种的状态。

建筑环境业（BE）因冠病疫情而备受冲击。幸好业界各方与政府紧密协作，建筑环境业已逐步走出疫情，出现复苏的迹象，建筑产量已恢复到接近冠病疫情爆发之前的水平。如今，虽然业内仍有一些挑战，不过业者已意识到有必要加快转型的步伐，以加强业务韧性和可持续性。

$184 Million to Accelerate Industry Transformation towards a more Resilient and Future-Ready Built Environment (BE)

The BE sector has been hard hit by the COVID-19 pandemic. However, with close partnership with industry stakeholders, the sector is seeing signs of recovery, with construction output recovering to close to pre-COVID levels. Some challenges still remain but the industry has recognised the need to accelerate ongoing transformation efforts to achieve long-term resilience and sustainability.

At the Ministry of National Development’s Committee of Supply debate today, several key initiatives were introduced to support willing and progressive firms in their transformation journey, and help them enhance their capabilities and capacity for a future-ready BE sector.

Streamlining of Entry Requirements for Construction, Marine Shipyard and Process (CMP) Sectors Work Pass Holders to Improve Workforce Resiliency

As the COVID-19 situation improves, the entry requirements for vaccinated new Work Permit Holders (WPH) will be streamlined.

Streamlining of Industry-led End-to-end Process into 2Day-Pre-departure Preparation Programme (PDPP)
From 13 Mar 2022, the industry-led process will be streamlined into:
A shorter 2-day PDPP in the source countries
On arrival in SG, workers who undergo PDPP will undergo a shorter onboarding regime of 3 days instead of up to 9 days currently at the MOM Onboard Centres
PDPP will be available in Bangladesh, India and Myanmar from 13 Mar 2022.

Streamlining of entry lanes for CMP work pass holders
From 1 May 2022, vaccinated new CMP WPH holding in-principle approval (IPAs) will enter through only one specified lane.
Countries with PDPP available: PDPP will be the main entry lane and WPHs will be required to undergo PDPP.
Countries where PDPP is not available: WPHs will continue to enter SG via the Work Pass Holder General Lane where they will be subjected to prevailing border measures and complete an onboarding programme where applicable upon arrival.

To give industry time to adjust to the new PDPP regime, from 13 Mar to 30 Apr 2022, new CMP workers from sources with PDPP can continue to enter via either the PDPP or the Work Pass Holder General Lane. Entry approvals will be prioritised for workers who have secured an application to undergo PDPP before arriving in Singapore.

All vaccinated existing CMP WPHs (holding on to issued work permits) returning to SG will continue to enter SG via the Work Pass Holder General Lane. Entry approvals under this lane will be prioritised.

Grant of Ex-gratia Extension of Time (EOT) to Contractors due to COVID-related delays for Public Sector Construction Contracts from Jul 2021 to Feb 2022

While the industry’s construction output has recovered close to pre-COVID levels, we recognise that the COVID-19 pandemic continued to impact site productivity due to border restrictions in the second half of 2021.

To mitigate the impact on eligible public sector construction contracts that have on-going works from 1 Jul 2021 to 28 Feb 2022:
The Government will grant an ex-gratia EOT of 33 days.
No claim or application is required from contractors.

Parties in private sector contracts are encouraged to make reference to the ex-gratia EOT provided and provide similar reliefs to contractors, where appropriate.

This will be the final broad-based grant of ex-gratia EOT for public sector construction contracts arising from COVID-related delay. For EOT after 28 Feb 2022, contractors can request for EOT arising from COVID-related delay with substantiation for their respective government agency clients to assess.

公共部门建筑合同：因冠病疫情而为2021年7月至2022年2月期间给予的特惠延长合同期 (EOT)

虽然建筑业整体的建筑产出已接近冠病疫情之前的水平，我们也意识到2021年下半年因冠病疫情的边境管制措施继续影响工地的生产力。

为了减缓疫情对业者的影响， 那些在 2021 年 7 月 1 日至 2022年 2 月28 日期间进行工程，并符合条件的公共部门建筑合同：
将获得政府机构以特惠方式给予的33天延长合同期 (EOT)
承包商无需提出延长合同期的申请

私人建筑合同的缔约方可以参考以上的特惠延长合同期，酌情提供承包商相应的援助。

这将是最后一次对公共部门建筑合同因冠病疫情相关延误，宣布广泛特惠 EOT 。对于2022年2月28日之后因冠病疫情相关延误，承包商可以提供凭据，和公共部门商讨EOT 。

Streamlined Safe Management Measures slated to start on 25 Feb postponed

MOH has announced today that the streamlining of existing Safe Management Measures will be implemented at a later date.

Please note the following updates for all construction worksites and supply work premises:

Relaxation of safe distancing requirement will be postponed until further notice. Safe distancing of 1 metre is still required between all workers.
There is no change to the removal of Rostered Routine Testing (RRT) regime. From 18 February 2022, vaccinated workers in the construction sector who are currently on Rostered Routine Testing (RRT) regime will no longer be required to continue testing. Only unvaccinated or partially vaccinated workers residing in the dormitories will still be required to undergo the 3-day supervised Fast and Easy Testing (FET)-RRT regime.

BCA will not be issuing any more ART kits for RRT. If your workers still have remaining ART kits, they can keep the kits and use them to monitor their health.

Vaccination remains key to enhancing workforce resilience against COVID-19. We urge all workers to get vaccinated and to get your booster shots when offered.

We would like to remind all worksites to verify the vaccination status and keep a proper record of all personnel entering the site. We seek your continued cooperation to comply with the updated safe management measures to keep our worksites safe.

Budget 2022 – Changes to foreign worker policies

The built environment sector is a key driver of Singapore’s economy. Due to heavy reliance on foreign manpower, our sector has been facing significant challenges with the restrictions on cross-border travel amid the COVID-19 pandemic. To mitigate impact of any future manpower disruption, we need to press on with productivity improvements to become more manpower-lean and resilient.

During Budget 2022, MOM, BCA, EDB and ESG have announced the following changes, which will take place from 1 Jan 2024. We will provide adequate lead time for the industry to adjust and minimise impact to existing projects:

Reduce the Dependency Ratio Ceiling (DRC) from 1 local employee to 7 Work Permit Holders (WPH) or S Pass holders to 1 local employee to 5 WPHs or S Pass holders.
Firms that exceed the new DRC after 1 Jan 2024 will be allowed to retain their existing WPHs and S Pass holders until their work passes expire.
They will not be able to renew their expiring or hire new WPHs and S Pass holders until after they come within the new DRC.
While about 9 in 10 Construction firms will not be currently affected by the reduction in the DRC, we urge firms to press on with their transformation plans to facilitate sustainable business growth and reduce their reliance on labour.

Phase out the Man-Year Entitlement (MYE) framework;
Firms can continue to apply for and use their MYE quotas up to 31 Dec 2023.
Projects that have already been awarded or projects with tender calling date on or before 18 Feb 2022, will be allowed to use their MYE quotas up to 31 Dec 2024 or their project completion date, whichever is earlier.

Revise the levy structure for WPHs

2022年财政预算案——外籍劳工政策调整

建筑环境业是新加坡经济的重要驱动力。不过这个行业过于依赖外籍劳工，以致业者在冠病疫情期间，因边境管制措施收紧而面对人力短缺的重大挑战。为了降低日后人力短缺可能造成的影响，我们有必要继续推进有助提高产力的措施，精简人力以及加强业务韧性。

人力部、建设局、经济发展局和企业发展局在2022年财政预算案中宣布的下列措施将从2024年1月1日开始实施，以便给业者提供足够的时间作出调整，尽量降低新措施对现有工程项目的影响：

调低外籍劳工比率顶限（DRC），从1名本地雇员对7名工作准证持有者（WPH）或S准证持有者，下调至1名本地雇员对5名工作准证持有者或S准证持有者。
在2024年1月1日之后，外籍劳工比率超出新顶限的业者，将允许保留其现有的工作准证和S准证持有者，直到他们的准证到期。他们将不能为外籍劳工更新到期的工作准证或雇用新的工作准证和S准证持有者，直到他们符合新比率顶限的规定。
虽然目前每10家建筑公司当中，大约有9家不会受比率顶限下调影响，但是我们还是要敦促业者继续推进转型计划，以实现可持续业务增长并减少对外籍劳工的依赖。

逐步淘汰外劳配额（MYE）制度；
业者可以继续申请和使用其外劳配额，直到2023年12月31日。
已经中标或招标日期在2022年2月18日或之前的工程项目，将允许在2024年12月31日或其项目完成日期之前使用其外劳配额，以较早者为准。
