Adopting Pandemic Resilient Contracting Practices For Public Sector Consultancy Agreements

For Public Sector Consultancy Tenders and Agreements

To help consultants address uncertainties in risk allocation and future-proof consultancy contracts, the public sector will be adopting the following pandemic resilient contracting practices from 1 Feb 2022:

Remuneration for project prolongation;

Remuneration for additional services rendered during project prolongation;

Provision of provisional sum for cost items that can be anticipated and co-sharing of unknown cost items; and

Clarification on computation of the equal monthly payment during the construction stage due to project prolongation


For Private Sector Consultancy Agreements

Private sector contract parties are encouraged to adopt similar principles to allow for more equitable sharing of risks among project parties through provision of price and risk certainty in new tenders.

No changes to construction worksite requirements

It was announced that from 1 January 2022, up to 50% of employees who can work from home are allowed to return to the workplace.

Non-Worksites
For the built environment sector, this applies to those who are not working at the construction worksite.

Employers must ensure only the following employees can return to the workplace:
Employees who are fully vaccinated
Employees who have recovered from COVID-19 within the past 180 days
Unvaccinated employees who have tested negative for COVID-19 within 24 hours of returning to the workplace via a Pre-Event Test at an MOH-approved COVID-19 test provider

Worksites
The announcement has no impact on those who are already working at a construction worksite. There are also no changes for the worksite SMM.

Reminder to Continue to Exercise Strict Adherence to Worksite SMM (Chinese version)

随着各地相继出现奥密克戎冠病变种毒株,我们要在此提醒建筑业者严格遵守工地安全管理措施,具体内容可查阅建设局于2021年10月16日发出的通告以及安全复工规定。这将有助我们降低工地出现冠病感染群的风险,避免工程进度以及工人的健康受到影响。

冠病检测仍然是我们及早发现和遏制冠病病毒传播的主要方式,包括奥密克戎变种毒株。建筑业者必须继续严格为工人实行快速简易检测和轮流定期检测(FET RRT),并把他们在受监督情况下完成的检测结果上载到拭子检测登记系统V2(SRSV2,适用于新加坡公民/永久居民)或FWMOMCare应用程序(适用于工作准证持有者)。

所有符合条件接种冠病疫苗的员工应该在接获邀请或安排时,登记接种疫苗或疫苗追加剂,以加强建筑业防控冠病疫情的能力。

建设局会随着更多有关奥密克戎变种毒株的信息出现,适时调整疫情防控措施,尽最大的努力降低对建筑业造成的影响。

Reminder to Continue to Exercise Strict Adherence to Worksite SMM

With the emergence of the COVID-19 Omicron variant, we would like to remind the industry to strictly adhere to worksite SMMs as outlined in BCA’s circular on 16 Oct 2021 and the COVID-Safe Restart Criteria. This would help minimise the likelihood of having COVID-19 outbreaks at worksites that would adversely affect site productivity and the health of our workforce.

Testing remains key to our early detection and containment of COVID-19 transmission, including the Omicron strain. Firms are reminded to continue adhering to Fast and Easy Test Rostered Routine Testing (FET RRT) requirements and upload their supervised ART results to SRSV2 (for SC/PRs) or FWMOMCare (for work pass holders).

All eligible personnel are encouraged to take up vaccinations and booster shots when offered or scheduled to enhance the industry resilience against COVID-19.

BCA may continue to adjust our measures accordingly as more information on the Omicron variant becomes available, with a view to minimise any impact on the industry.

Deferment of RRT Exemption for Fully Vaccinated COVID-19 Recovered Workers

From 1 December 2021
Due to the new Omicron COVID-19 variant, fully vaccinated COVID-19 recovered workers (CRWs), who are beyond 270 days from their date of infection are required to continue to be on mandatory Rostered Routine Testing (RRT) regime. RRT exemption has been deferred for this group of workers till further notice.

We would like to seek employers’ assistance to:
ensure your workers do their RRT on time and
complete the full vaccination regime as soon as possible.

Updated Testing Regime for Fully Vaccinated COVID-19 Recovered Workers (Chinese version)
已完成冠病疫苗接种的康复工人的最新检测制度

从2021年12月1 日起
所有已完成冠病疫苗接种的康复工人,包括那些从受感染首日算起已超过270天的康复者,全都可豁免接受轮流定期检测(RRT)。
豁免接受轮流定期检测的工人,他们的FWMOMCare、Safe@Work、Safe@Dorm和SGWorkPass手机应用程序上将不再出现轮流定期检测的时间表。

2021年12月15日起,工人的通行码(AccessCode)将出现改变
如果您的工人必须接受轮流定期检测,但是却没有按照规定的时间表接受检测,或者检测结果呈阳性,他们的通行码将呈红色状态。他们将不被允许去工作。
只有当他们按照规定接受轮流定期检测,并上传抗原快速检测(ART)结果,或是完成抗原快速检测呈阳后的康复程序之后,他们的通行码也转为绿色。

我们促请您全力配合,确保您的工人按时做轮流定期检测,并尽早完成他们的冠病疫苗接种。

Updated Testing Regime for Fully Vaccinated COVID-19 Recovered Workers

From 1 December 2021
All fully vaccinated COVID-19 recovered workers (CRWs) including those who are beyond 270 days from their date of infection are exempted from Rostered Routine Testing (RRT).
If workers are exempted from RRT, they will no longer see their RRT schedule on FWMOMCare, Safe@Work, Safe@Dorm and SGWorkPass.

Changes for AccessCode from 15 December 2021
AccessCode status will turn “red” for workers who are required to undergo RRT but have missed their appointments or tested ART positive. They will not be allowed to go to work.
Their AccessCode status will turn “green” only after they have performed the required RRT and uploaded the results or completed the ART positive recovery protocol.

We would like to seek your assistance to ensure your workers do their RRT on time and should they be unvaccinated, to complete the full vaccination regime as soon as possible.

Grant of Ex-gratia Extension of Time (EOT) to Contractors due to COVID-related delays for Public Sector Construction Contracts from Jan to Jun 2021

As the COVID-19 pandemic continues to impact productivity on site, construction projects have faced further delays.

To mitigate the impact, the following will apply for eligible public sector construction contracts that have on-going works from 1 Jan 2021 to 30 Jun 2021:
The Government will grant an ex-gratia EOT of 34 days.
No claim or application is required from contractors.

Parties in private sector contracts are encouraged to make reference to the ex-gratia EOT provided and provide similar relief to contractors, where appropriate.
